General terms and conditions Driving school Compas

 

Article 1. General.

 

These terms and conditions represent the rules by which we conduct our driving education of categories B, A and AM ending in the CBR/BNOR examinations.

They apply to the instructors of this driving school.

 

Article 2. Obligations of the driving school.

 

Driving lessons are given by certified instructors according to the (WMR) Wet Rijonderricht Motorvoertuigen- Law driving education motor vehicles.

Students will preferably be taught by the same instructor every time.

The time of the lesson will be fully used for instruction and teaching, as agreed in the contract.

The student is entitled to use the same vehicle during lessons and exams. When an emergency occurs, a similar vehicle will be arranged in time.

The driving school has an insurance police.

Smoking is not allowed in the car. Our instructors don’t smoke at all.

 

Article 3. Students’obligations.

 

The student has to keep the set date, time and place of the lesson. The instructor will wait for 15 minutes max.

When there is a no-show for a lesson, the lesson will still be charged to the student.

Lessons should be cancelled at least 24 hours in advance with your instructor. (not including Sundays and official holidays)

The student should follow the instructions given by the instructor during the lessons at all times.

The student should also follow the lesson plan that he has made with the instructor, about the frequency of the lessons and the dates of the tests.

Alcohol/Drugs

Since it is forbidden to drive under the influence of alcohol or drugs; it is also forbidden to drive under the influence during your lessons. When this would be the case, the lesson will be cancelled, but will still be charged. (The student has prime responsibility, but when in doubt the instructor will make a decision).

Identification. You need to carry a legal identification card, for unexpected police checks, to prove you have the right age. You can use an ID-card or a passport.

Eyesight.

You need to have your eyes tested at an optician, if you haven’t had e resent check-up.

 

Article 4. Payments.

 

The student is obligated to pay the agreed price for his/her education before the set date. All lessons and exams should be paid for before the exam takes place.

Payments can be made by bank or in cash.

The driving school is entitled to raise prices during the time of a contract. The student is then entitled to cancel the contract within two weeks after the price raise.

Students are in default when payments have not been done to the instructor before the set date, without any admonition required.

When payments are due, the driving school is entitled to cancel the lessons and the reservation of the exam.

 

Article 5. Driving education.

 

The driving education encompasses driving lessons, given by certified instructors, the time of the lessons 90 minutes for car, 120 minutes for motor cycle and 120 minutes for moped which are fully used for instruction and teaching to correctly aged students.

Category B 16,5 years old.

Category B 17 years old.

Category AM 16 years old.

 

Article 6. Driving examination.

 

When the driving examination is cancelled by the CBR because of bad weather conditions, the driving school is entitled to charge for extra lesson to be taken by the student.

Students are free of extra charges when they have to cancel their driving exam for the following reasons:

when the student is ill and has a statement from the doctors, this should be shown to the driving school within 7 days after the examination date. The student will have to pay €16,50 for the annulment to the CBR.

when a family member of the first and second degree of the student or the instructor has deceased within 4 days of the examination date or is buried on the examination date.

when the lesson vehicle or a similar one are not available at the time of the examination.

when the lesson vehicle is declared unfit by the examiner. The driving school will then apply for a new exam without any extra charges.

When the driving school has reserved an exam for a student, the student will have to supply the right documents.

 

 

Article 7. Examination payments.

 

When a reservation for an exam is made the payments have to be done in advance by bank or in cash.

 

Article 8. Liability.

 

Student are not liable for any damage to other persons or vehicles as a result of a collision or crash during lessons and exams.

Driving school Compas is not liable for any damages caused by the student purposely or under the influence of alcohol, drugs or other medicine which are intoxicating.

Driving school Compas is not liable for fines or other financial consequences when a student, despite his/her own statement, is unauthorized to drive the lesson vehicle.

Motorcycle students are obligated to pay for their own speeding fines. They are responsible for the speed at which they drive.

 

Article 9. Finishing your contract.

 

When our driving school does not fulfil it’s obligations a student can stop taking lessons without any costs.

A student can also end the contract in writing if there might be an urgent reason for him/her not to be able to continue driving lessons. Our driving school will then refund all unused lessons, exams and administration costs within 14 days.

 

Article 10. Complaints procedure.

 

A student can make a complaint when there should be an argument between him/her and the instructor. You should contact the driving school for mediation.

An appeal for mediation should be done preferably directly by phone or in writing to the driving school within seven days after the argument.

When mediation does not solve the problem, the case will be presented to court.

Dutch laws will be applied in these cases.
